Personal Data Management Policy
In compliance with the provisions of Law 1581 of 2012, Regulatory Decree 1377 of 2013, and Ruling C748/2011, which declared the Statutory Law on personal data protection constitutional, Netdata adopts this Policy for the Processing of Personal Data (hereinafter, "The Policy"). This policy will be communicated to all data subjects whose information is collected or obtained in the future.

GUIDING PRINCIPLES
Netdata, hereinafter "Netdata," a company headquartered at Carrera 9 # 115 – 30 Edif. Tierra Firme, Office 608, Bogotá D.C., Colombia, website: https://www.netdatanetworks.com, in compliance with Decree 1377 of 2013, has developed this policy for managing the personal data of our Clients and Users in the various business lines of the Company.
Netdata is responsible for all personal information in its possession or control, including data received directly as the data controller from individual clients, prospective clients, employees, contractors, or job applicants. It is also responsible for processing personal data received indirectly, such as from corporate or government clients.
To this end, policies and procedures have been established to protect personal information. Netdata values the importance of ensuring that our Clients and Users are aware of this policy, and we invite you to read it in full.
Netdata guarantees the rights to privacy, intimacy, and reputation in processing personal data. All its actions will be governed by the principles of legality, purpose, freedom, truthfulness or quality, transparency, restricted access and circulation, security, and confidentiality. Any individual providing personal data to Netdata may access, update, correct, delete, or revoke prior authorization.
DEFINITIONS
For the interpretation and application of this policy, the following definitions apply as per the law:
- User: A natural person whose personal data is subject to processing.
- Database: A structured set of personal data subject to processing.
- Personal Data: Any information linked or associable to one or more identifiable natural persons.
- Data Processor: A natural or legal person, public or private, who, alone or jointly with others, processes personal data on behalf of the data controller.
- Data Controller: A natural or legal person, public or private, who, alone or jointly with others, decides on the database and/or data processing (in this case, Netdata and its affiliated companies).
- Authorization: Prior, express, and informed consent from the data subject for processing their personal data.
- Data Subject: A natural person whose personal data is being processed.
- Processing: Any operation or set of operations performed on personal data, such as collection, storage, use, circulation, or deletion.
- Sensitive Data: Information that affects the privacy of the data subject or may lead to discrimination, such as racial or ethnic origin, political orientation, religious or philosophical beliefs, union membership, health-related data, sexual life, and biometric data.
COLLECTION AND MANAGEMENT OF PERSONAL DATA BY NETDATA
This policy applies when Users engage in activities such as solution studies, demonstrations, service or equipment quotations, direct purchases from Netdata, or referrals through third parties where Netdata processes personal data.
Upon granting authorization for data collection and processing, the data may be used for marketing and advertising activities, data analysis, market intelligence, sending information about products, services, promotions, events, alliances, and offers, as well as service improvement.
Netdata may transfer the provided personal data to third parties within or outside Colombia, subject to authorization unless exceptions apply under Law 1581 of 2012.
Users may opt out of receiving marketing messages at any time by responding to our communications and expressing their preference.
PURPOSE OF THE POLICY
This Policy aims to establish general guidelines for compliance with Law 1581 of 2012 and Decree 1377 of 2013, which regulate the management of personal databases in Colombia. It defines the criteria for collecting, storing, using, circulating, and deleting personal data processed by Netdata.
SCOPE OF THE POLICY
This Policy applies to all personal data recorded in Netdata's databases, including employee, client, and supplier data, without limitation.

RIGHTS OF DATA SUBJECTS
Data subjects have the following rights:
- Free access to their processed data.
- Know, update, and correct their data when it is partial, inaccurate, incomplete, misleading, or unauthorized for processing.
- Request proof of granted authorization, except in cases where authorization is not required.
- Be informed upon request about the use of their personal data.
- File complaints with the Superintendence of Industry and Commerce for violations of data protection regulations.
- Revoke authorization or request data deletion when no legal or contractual obligation prevents it.
- Refuse to provide sensitive data, with such requests being optional.

Netdata will process personal data solely for the purposes authorized by the data subject, including:
- Business operations related to Netdata’s corporate purpose.

SECURITY INCIDENT MANAGEMENT
Incident management is crucial for continuous improvement in information security. Organizations must ensure that causes, responses, and solutions contribute to corrective and preventive actions for future security incidents.
Netdata will implement proper security controls and monitor incidents to safeguard personal data integrity, availability, and confidentiality.
POLICY VALIDITY AND UPDATES
This Policy takes effect upon approval on 08-03-2018 and remains in force indefinitely unless substantially modified by legal regulations such as Law 1581 of 2012 and Decree 1377 of 2013. Employees are required to understand, implement, and maintain compliance with this Policy.
